Court: Lap dances aren’t tax-exempt Posted: 11 Jun 2011 01:45 PM PDT ALBANY, NY — While a lap dance might prompt a strong reaction from an audience, it doesn’t rise to the level of art — at least according to a state appellate court. Thursday’s ruling said entertainers at a local strip club are subject to sales taxes, and their expressions are not considered choreographed artistic performances that would be exempt. Nite Moves, an adult “juice bar” on Route 9 in Latham, has been fighting the tax law — first in an administrative hearing and then in court — following a 2005 audit by the state Division of Taxation that concluded the club owed nearly $125,000 in sales tax, plus interest for door admission charges and private dance sales. The Appellate Division of state Supreme Court upheld that decision in an unanimous opinion. Patrons at Nite Moves “view exotic dances performed by women in various stages of undress,” the decision said. Revenue is generated from admission charges, “couch sales” — the fee charged when a dancer performs for a customer in one of the club’s private rooms — as well as register sales from the non-alcoholic beverages sold and house fees paid by the dancers to the club. Gingrich’s campaign was a farce. Palin will not run. I have said these things from the beginning. The real battle is not between Palin and Bachmann, but between Dr. Paul and Bachmann. Remember where you heard it. This will be a big story soon. Ron Paul can stake a fair claim to being the father of the Tea Party movement. He has made his arguments intelligently and well for many years. Depending on the final field, he could emerge the kingmaker at the convention if his votes are near the ceiling of his potential, rather than the floor. While I view Palin as a lightweight creation of television opiners who have a long history of being almost always wrong about politics, I have suggested for some time that Michele Bachmann is a major league player who should not be underestimated. Bachmann is hiring first-rate staff and has been brushing past Palin for some time now. As the campaign gets serious and the debates get attention, watch the battle unfold between Paul and Bachmann in the high noon showdown on the right of the GOP. Dr. Paul will have to get past Bachmann to approach the higher end of his potential support. Michele Bachmann will have to get past Paul and become the final candidate of the right. PORTSMOUTH — Presidential hopeful Congressman Ron Paul, R-Texas, stood between aisles of candy and New England-themed knickknacks as he greeted guests inside Maine-ly New Hampshire on Friday morning. Paul wasn’t just visiting to pick up some novelties, however — he spoke of his stance on topics such as federal spending, United States involvement overseas and limiting the federal government. Kenneth Smith, one of the proprietors of the Deer Street shop, struck up a conversation with the 2012 candidate about where he stood on federal spending within the country versus spending in foreign territories. Smith spoke of a bridge that connects the Port City and neighboring Kittery, Maine, needing serious repairs. Paul joked with Smith, saying it would be easier to obtain federal funding to build or fix a bridge if it were located in Afghanistan. “It’s a major economic issue,” said Paul, noting America’s current leaders are choosing to flood finances into military-related conquests as opposed to taking care of what needs fixing within their own country. “The deficits are unsustainable,” he said. When offering suggestions as to where he would cut spending first if elected into the oval office, Paul rattled off entities such as the departments of Education, Energy and Agriculture. Though he claimed there are many places where cutting could take place, Paul said the federal government shouldn’t be subsidizing expenses that come from the aforementioned departments. TSA Considering Banning Photography Of Checkpoints Posted: 11 Jun 2011 08:48 AM PDT The Transportation Security Administration is considering changing its policy on photographing security checkpoints after several videos depicting questionable incidents between passengers and TSA screeners were posted on Youtube. News of the possible changes in policy was posted Friday on the TSA Blog, the same blog that posted that it is permissible to photograph checkpoints, even though most screeners act as if it has always been illegal. The reason it is considering changing its policy stems from a Youtube video that was recorded in Phoenix when a woman opted-out of the metal detectors and chose to get patted down by a TSA screener. The woman began yelling hysterically that she had been molested by the screener. Meanwhile, the woman's son was recording the incident and continued to do so, even though several TSA screeners told him he was breaking the law. TSA Admits ‘Bad Judgment’ After Disabled Man Subjected to Airport Pat-Down Posted: 11 Jun 2011 08:45 AM PDT Detroit – A Detroit father said agents with the Transportation Security Administration singled out his special-needs son for a pat-down while the family was headed to Disney World, MyFoxDetroit.com reported, an incident that the TSA admitted was a "case of bad judgment." David Mandy said agents at Detroit Metro Airport took his son Drew, 29, and asked him about the padding underneath his pants, which turned out to be adult diapers. Drew, who is severely mentally disabled, had trouble understanding the agents' orders because his family said he has the mental capacity of a 2-year-old. When the father tried to intervene and explain Drew's disability, he said the two agents said, "Please, sir, we know what we're doing." The agents confiscated a six-inch plastic hammer, something Drew had carried with him for 20 years for comfort. Agents called it a security threat, his father said, adding that they tapped the wall with it and said, "See, it's hard. It could be used as a weapon." Eventually viewers will have to pay between $4.95 and $9.95 a month to subscribe. All in all the result was impressive, not the least because Beck himself seemed to have regained some of the lightheartedness and humor so notably missing on his FOX News show in the last few months. More importantly, it was engaging. (The Soros cartoon was merely an added bonus, but more on that later). What’s clear is that Beck’s team has no real interest in producing a web show; they fully intend to turn-out a high quality television show that just happens to air on the web. It’s a strategy that has a resulted in a lot of speculation and skepticism from media types (and presumably the attention of a LOT of media execs) but which in the viewing feels like far less of a stretch — watching TV online isn’t exactly a new thing, in fact it’d be interesting to know how many people actually see the Daily Show during its airtime vs. next day clip viewing. US Attorney for Oregon attempts to squelch First Amendment Posted: 11 Jun 2011 08:22 AM PDT By Russ Belville, Examiner.com Dwight Holton, the US Attorney for Oregon, tried to silence a lawful protest by marijuana legalization activists on City Hall steps in Portland this morning, according to attorney Paul Loney. Holton recently authored a letter circulated to cannabis patients’ clubs threatening federal law enforcement action. The letter was endorsed by 33 of the 34 Oregon county district attorneys. Multnomah County D.A. Michael Shrunk declined to sign on, saying, “I don’t like to threaten things that we realistically are not geared up to do,” and “combating this cannot be termed a critical priority when balanced against others." From the Holton letter: "Oregon and Federal law make it illegal to sell marijuana – period, end of story," said Holton. "The breathtaking surge in manufacture and distribution of marijuana in Oregon is putting marijuana in the hands of more and more healthy kids — and dispensaries are fueling this crisis. We are confident that responsible landlords and property owners will remove the operators of illegal dispensaries and ‘cannabis clubs’." In response to the crackdown, Madeline Martinez, proprietor of one of the threatened clubs, the World Famous Cannabis Cafe, called a press conference Friday afternoon at the Portland City Hall steps. The permit had been turned in on Monday, according to Oregon NORML Legal Counsel Paul Loney.
